This Royalty-Free Licence Agreement governs the rights and limitations associated with the use of the purchased images which are available through the Vizero.com website. The terms "image", "photograph" and "product" are used interchangably in this document and refer to the same thing.
We strongly recommend that you read through this document in its entirety before purchasing any image for commercial use or agreeing to publish your work on this website. Use of any services, including uploading or purchase of images, on Vizero.com signifies that you understand and agree in entirety with the terms set forth in this agreement. This is an obligation and you are legally bound by it.
Photographer
By publishing an image on Vizero.com you certify that you are the sole copyright holder of the image and that this image can be used on a perpetual basis for both commercial and non-commercial purposes. Further you warrant Vizero.com the rights, model releases and consents to retail this image on a Royalty-Free, non-exclusive perpetual basis, according to the conditions governed by this agreement.
Purchaser
By purchasing a photograph the buyer obtains the right to download a watermark-free image, of an agreed resolution, from our website during a seven (7) day period from the date of the original purchase. Further he/she obtains the non-transferable, non-exclusive perpetual right to reproduce, print, display, adapt, edit, publish or use the the image in any media, an unlimited number of times and for any purpose subject to the restrictions stated below:
- re-selling, distribution or sub-licensing of an image is not permitted, this includes but is not limited to uses such as posters, postcards and calendards where the image forms the main part of a commercial product
- pornographic, defamatory, libellous or otherwise unlawful use is strictly prohibited
- use the image or its derivatives in a context that implies that any model in the image personally uses or endorses a product or service (e.g. testimonial advertising)
The buyer will, through purchase, not obtain the copyright ownership of any image, which shall remain with the original creator. Upon purchase of the image the purchaser is assumed to have made him/herself aware of the contents of this licence and agreed to be bound, without reservations, by the conditions and restrictions stated in this agreement.
Limitation of Liability
The images are sold on an "as is" basis and Vizero Ltd or the copyright owner will not be held responsible for any issues directly or indirectly relating, but not limited to, the performance of the image in the context for which the buyer had intended. In no circumstances will Vizero Ltd be held liable for any consequential, incidental, direct or indirect damages that result from the abuse, misuse or corruption of the product.
Duration
This User’s agreement shall remain in full force and effect throughout the entire duration of use of the image. It shall be terminated in the event the user does not comply with the terms and conditions of this agreement or the Terms and Conditions of Use as stated on this website. Upon expiration of this License Agreement, the user hereby agrees to destroy all copies he or she has made of the image.
